    Parties to this agreement are Oak Employment and temporary worker (you) identified below.

    As defined by the conduct of employment agencies and employment businesses regulations 2003. Oak Employment is an employment business.

    In these terms, the following definitions apply; Client refers to the person or business requesting services of a temporary worker. This assignment refers to the time to which the temporary worker is working under the supervision, direction and control of the client.

    References to the singular, include the plural and references to the masculine, include the feminine and vice versa. These terms are governed by English law and are subject to the exclusive jurisdiction of the English courts.

    These terms of engagement establish a contract for services between Oak Employment and you. They regulate every assignment undertaken by you. However, no contract shall exist between Oak Employment and you between assignments.

    To ensure clarity of understanding, these terms shall not act as a contract of employment between you and Oak Employment. You are not engaged as an employee, instead you are a worker. However, Oak Employment is required to make statutory deductions from your remuneration.

    Based on your initial application, Oak Employment will seek to obtain suitable assignments for you.

    There is no probationary period in relation to your engagement.

    If you do not attend work for any reason, or do not accept an assignment, there shall be no contract between you and Oak Employment.

    Temporary work can result in periods of time when there is not suitable work available to you. You agree that the suitability of jobs for you will be wholly identified by Oak Employment. Oak Employment will hold no liability should suitable work not be found.

    As a temporary worker you have no regular hours of work. You will be required to work on a ‘as required’ basis. Your hours and place of work may vary, this is dependent upon the requirements made by the client.

    Oak Employment will pay you remuneration which is calculated at the pre-agreed hourly rate and overtime rates for each hour worked during an assignment. You will be paid at least the appropriate national minimum wage. You will be paid weekly in arrears, subject to deductions, for the purposes of class one national insurance contributions, PAYE and any other deductions which Oak Employment may be required to make by law. You will be paid for the work you have done, even if the client does not pay Oak Employment. However, payment may be delayed until Oak Employment is satisfied that the work was done.

    Subject to any statutory entitlement, you will not receive payment from Oak Employment or its clients for time not spent on assignment, whether in respect of holidays, illness or absence for any other reason.

    You are entitled to a maximum of 28 days paid leave each year. Entitlement to paid leave accrues in proportion to the amount of time worked continuously, by you, on an assignment, during the leave year. When you wish to take any accrued leave to which you are entitled, you must notify Oak Employment in writing of the dates of your intended absence. The amount of notice which you are required to give is at least twice the length of period of leave that you wish to take. The minimum leave you can take is 1 day.

    ‘Leave Year’ is the year used for calculating entitlement to leave, and starts on 1st March. You must take leave in the leave year, or you may lose the entitlement, and if you have been paid, you must take the leave.

    If an over payment has been made to you, in respect of pay and/or leave pay to which you are not entitled, a deduction will be made on your subsequent pay to reflect the over payment. None of the provisions of the clauses regarding the statutory entitlement paid leave shall affect your status as a worker, who is not an employee.

    You may be eligible for statutory sick pay provided that you meet the relevant statutory criteria.

    Oak Employment, its client or you may end an assignment at any time without any liability or notice.

    You may be automatically enrolled on Oak Employment’s workplace pension scheme if you are eligible.

    You are not obligated to accept any assignment offered to you by Oak Employment. If you do accept, the following rules will apply for every assignment:

    1. you must co-operate with the client’s staff and accept the direction, supervision and instruction of any responsible person in the Client’s organisation.

    2. You must observe any rules and regulations of the Client’s establishment.

    3. Unless arrangements have been made to the contrary, you must conform normal hours of work at the Client’s establishment.

    4. You must take all reasonable steps to safeguard your own health and safety and the safety of any other person that may be present or affected by your actions on the assignment and comply with the health and safety policy of the client.

    5. You must wear or use PPE as instructed by the Client

    6. You must not engage in any conduct detrimental to the interests of the Client

    7. You must inform us if the Client requires you to work for longer than the standard weekly hours, or does not make you take adequate rest

    8. You must comply with applicable or relevant laws

    You agree that you are liable for any fines and/or penalties you incur, including parking and driving penalties. Oak Employment may deduct the cost of these from your remuneration. You agree to be liable for any property not returned to the Client and Oak Employment may deduct the cost of such items from your remuneration.

    You will not at any time divulge to any person, used for your own or any persons benefit, any information in relation to the clients or Oak Employment’s business affairs, transactions or finances.

    If you are unable to work for any reason, you agree to contact Oak Employment, giving a minimum of one hour’s notice before you are due to begin work for the client.

    You must keep Oak Employment informed of your current email address, phone numbers and postal address.

    You must inform Oak Employment of any health and safety issues, incidents/accidents that occur while on assignments.

    No variation or alteration of these terms shall be valid unless approved by Oak Employment in writing.
